Terms of use

These terms are an agreement between you and 95 Pound Kitchen ("we", "us") for your use of the GetSwapped app. By creating an account or using the app, you agree to them. Our privacy policy explains how we handle your data.

Who can use GetSwapped

You must be 18 or older. You are responsible for your account and for keeping access to the email address you sign in with.

Not medical advice

GetSwapped is a cooking and food-tracking tool. It is not medical, nutritional or dietary advice, and it doesn’t diagnose, treat or prevent any condition. Talk to a healthcare professional before starting any diet or weight-loss plan, especially if you are pregnant, have a medical condition or take medication.

Nutrition information is an estimate

Calories and macros for recipes are calculated from ingredient weights using USDA data. Food search and barcode results come from USDA FoodData Central and Open Food Facts, which includes community-entered labels. Actual values depend on the brands, portions and cooking methods you use, so treat all numbers as estimates.

Allergies and food safety

Allergy and diet filters are based on the ingredients we list and are a convenience only. Always read product labels and check each ingredient yourself. Pantry scans use AI and can miss or misidentify items. Follow safe food handling and cooking temperatures. Recipe photos are illustrations and may not show the exact dish.

Subscriptions

Some features may require a paid subscription or purchase. When offered, payments are handled by Apple and charged to your Apple account. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel them in your Apple account settings. Refunds are handled by Apple under its policies. Deleting the app or your account does not cancel a subscription.

The free plan includes a limited number of pantry scans each week. We may change which features are free or paid, and will tell you before a change affects something you already pay for.

Your content

Your food log, lists and preferences belong to you. You give us permission to store and process them only to run the app for you, as described in the privacy policy.

Our content

Recipes, photos, text, the GetSwapped name and logo, and the app itself belong to 95 Pound Kitchen or its licensors. You may use them for your own personal, non-commercial cooking. Don’t copy, resell or republish them.

Acceptable use

Don’t misuse the app. For example, don’t try to access other people’s data, get around the free-plan limits, overload or reverse engineer our systems, or use the app for anything illegal.

Ending your use

You can stop using GetSwapped and delete your account at any time in Profile. We may suspend or close accounts that break these terms. We may change or discontinue features, and will give notice where we reasonably can.

Disclaimers

The app is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including that the app will be error-free, always available, or that nutrition information is accurate or complete.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for any loss arising from your use of recipes or nutrition information. Our total liability for any claim is limited to the amount you paid us in the 12 months before it, or $50 if you paid nothing. Some places don’t allow these limits, so they may not apply to you.

Apple

These terms are between you and us, not Apple. Apple is not responsible for the app, its content, support or maintenance, or any claims relating to it. If the app fails to meet a warranty, you may notify Apple for a refund of the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm you are not in a country subject to US embargo and are not on any US government list of restricted parties.

Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. If you live outside the US, you keep any protections your local consumer laws give you.

Changes to these terms

If we change these terms, we will update the date at the top. If a change is significant, we will tell you in the app before it takes effect. Continuing to use the app after that means you accept the new terms.
